1. About these Terms

These Terms of Sale apply to consumer retail orders placed through curiousworkings.com.

Please read them together with our Delivery & Shipping, Returns & Refunds, Privacy & Cookies and Legal Information pages.

Separate terms or arrangements may apply to school, organisational or bulk orders agreed with us separately.

By placing an order, you confirm that you are at least 18 years old and legally capable of entering into a contract.

2. Who we are

Curious Workings is an independent children’s publishing imprint and a trading name of Shuya Zhong, operating as a sole trader in the United Kingdom.

3. Placing an order and our contract with you

When you place an order through our checkout, you are offering to buy the products in your order.

Please check your order, delivery details and payment information carefully before submitting it.

Payment may be authorised or collected when you place your order. We accept your order when we send you an order confirmation confirming the purchase. A contract between you and Curious Workings is formed at that point.

If we cannot accept your order, we will let you know and will refund any amount you have paid for the affected item or order.

Orders enter fulfilment quickly after they are accepted, so we cannot guarantee that an order can be changed or stopped after it has been placed. Your cancellation and return rights are explained in our Returns & Refunds policy.

4. Prices and payment

All prices on the website are shown in pounds sterling (GBP).

The product price and any applicable delivery charges will be shown before you place your order. The total amount payable will be displayed at checkout.

Prices may change from time to time, but changes will not affect an order that we have already accepted, except where there is an obvious pricing error as described below.

Payment is processed through Shopify and the payment methods made available at checkout.

If a promotion or discount has separate terms, those terms also apply to that promotion.

5. Products

We take reasonable care to describe and display our products accurately.

Colours and appearance may vary slightly depending on your screen or device. Printed products may also have minor variations arising from normal printing and manufacturing processes. These minor differences do not affect your statutory rights where a product is faulty, damaged or not as described.

Our physical products are generally produced and fulfilled on demand.

Product availability may change. We may also apply reasonable quantity limits where necessary.

6. When we may be unable to fulfil an order

In limited circumstances, we may be unable to accept or fulfil all or part of an order.

This may happen, for example, if:

• a product becomes unavailable;
• there is an obvious pricing or product-description error;
• we are unable to process or verify payment;
• we reasonably suspect fraud, misuse or an unauthorised transaction;
• the delivery address is outside an area we currently serve; or
• we cannot fulfil the order for another genuine operational or legal reason.

If we cancel an order after taking payment, we will refund the amount paid for the affected item or order to the original payment method.

We will not rely on this section to remove rights that you have under consumer law.

7. Delivery

We currently deliver to UK addresses only.

Delivery charges, estimated delivery times, split deliveries and tracking are explained in our Delivery & Shipping policy.

Delivery times are estimates rather than guaranteed dates, but this does not affect any rights you have where goods are not delivered within an agreed or legally required timeframe.

We remain responsible for the goods until they are delivered into your physical possession or the possession of a person identified by you to receive them.

8. Delivery information provided by you

You are responsible for providing a complete and accurate delivery address when placing your order.

Because orders may enter fulfilment quickly, we cannot guarantee that an address can be changed after an order has been placed.

If an incorrect or incomplete address provided by you results in reasonable additional delivery or re-delivery costs, we may ask you to pay those additional costs before re-delivery.

This does not affect your rights where a delivery problem was caused by us or by a delivery provider rather than by incorrect information supplied by you.

9. Cancellations, returns and refunds

Our Returns & Refunds policy explains:

• our 28-day change-of-mind returns policy;
• return postage;
• refunds of applicable original delivery charges;
• cancellation before delivery;
• faulty, damaged, misprinted or incorrect items; and
• how to start a return.

Nothing in these Terms or in our Returns & Refunds policy affects your statutory rights.

10. Website content and intellectual property

Unless otherwise stated, the text, illustrations, graphics, logos, photographs, designs and other content on this website are owned by or licensed to Curious Workings and are protected by applicable intellectual-property laws.

You may view and use the website for your own personal, non-commercial purposes.

You must not reproduce, distribute, sell, commercially exploit or create unauthorised derivative works from website content without the relevant rights holder’s permission, except where permitted by law.

Nothing in these Terms transfers ownership of any intellectual-property rights to you.

11. Shopify and third-party services

Our custom website integrates with Shopify, which provides checkout, payment, customer-account and related ecommerce services.

Products purchased through our store are sold by Curious Workings, not by Shopify.

We may also use third-party service providers for production, fulfilment, delivery and other business functions.

Links to third-party websites or services may be provided for convenience. Their own terms and privacy policies may apply when you use those services.

12. Our responsibility to you

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for fraud, death or personal injury caused by negligence, or your statutory rights relating to goods.

If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of our breach or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

These Terms are intended for consumer retail purchases. We are not responsible for business losses such as loss of profit, revenue, business opportunity or commercial interruption arising from a consumer purchase.

13. Privacy

Our use of personal information is explained in our Privacy & Cookies policy.

Our online shop uses Shopify for checkout, payments, customer accounts and related ecommerce services. Shopify may also process personal information as explained in that policy.

14. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in our services, business practices or legal requirements.

The Terms that apply to your purchase are the Terms in effect when your order is accepted, unless a change is required by law or you agree otherwise.

The latest version will be published on this website with an updated date.

15. Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, this does not affect any mandatory rights or protections available to you under the law that applies where you live.

Nothing in these Terms prevents you from bringing proceedings in a court that consumer law permits you to use.
